CIVIR’s Privacy Policy is governed by compliance with current legislation on the protection of personal data and the Law on Information Society Services and Electronic Commerce. The objective of this Policy is to protect the information on the Internet, in the same way that it is protected in other media. CONSULTORÍA INTEGRACIÓN Y VIRTUALIZACIÓN, S.L is the owner of the website www.civir.es, and exposes in this section the Privacy Policy on personal information that the user can provide when visiting our website.

1.- Definitions

In compliance with the provisions of the regulations on Protection of Personal Data, CONSULTORÍA INTEGRACIÓN Y VIRTUALIZACIÓN, S.L (CIVIR) informs you that the personal data provided by filling in the form “Contact-Send us a message” and “Leave a comment”, will be incorporated into a file owned by CIVIR, being able to exercise, as indicated in paragraph 4, your rights of access, rectification, deletion, opposition, limitation of treatment and other rights contained in arts. 15 to 22 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data (General Data Protection Regulation – GDPR).

If the user decides to use any of the web forms the necessary data requested will be processed in order to meet your request. In this sense, the corresponding registration in these forms implies the express authorization by the user to send information to your email address and / or cell phone. On the possibility of exercising the rights regarding data protection (see section 4).

In compliance with Law 34/2002, of July 11, 2002, on Information Society Services and Electronic Commerce, (hereinafter LSSIyCE) CIVIR will not send by e-mail advertising communications that have not been authorized by users.

In those cases where it is necessary to fill in a form and click on the validate or send button, its completion will necessarily imply that you have been informed and, where appropriate, have given the corresponding consent to the content of this privacy policy. Thus, whenever CIVIR requests personal data, it will include a link to this Privacy Policy in order to make you aware of your rights and obligations. The user must fill in the application forms with true, accurate, complete and updated data, being informed at the same time of those data that must be filled in and the consequences of not doing so. Likewise, by accepting, the user acknowledges that the information and personal data collected are accurate and truthful.

3.- Secutity measures

At CIVIR we are aware of how important your personal information is to you. Therefore, we are committed to transparency in all matters relating to the privacy and security of the information we process. We strive to adopt all necessary security measures to ensure the protection of the personal data we process, and we are highly committed to its continuous improvement, adapting to current legislation and the technology available at all times.

Therefore, CIVIR informs you that it has implemented the necessary technical and organizational security measures to ensure the security of your personal data and prevent its alteration, loss and treatment and/or unauthorized access, given the state of technology, the nature of the data stored and the risks to which they are exposed, whether from human action or from the physical or natural environment.

CIVIR has established additional measures in order to reinforce the confidentiality and integrity of the information in the organization, such as the establishment of limitations to the use of electronic mail when sending confidential data or documents. 4.- Exercise of the rights of access, rectification, cancellation and opposition

Those individuals who have provided their data may contact CIVIR, in its capacity as owner and controller of the file, in order to be able to exercise their rights of access, rectification, deletion, opposition, limitation of processing and other rights recognized in arts. 15 to 22 of REGULATION (EU) 2016/679 OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation-RGPD).

Given the confidential nature of the information, you will not be able to exercise your rights by telephone, since this means does not allow you to prove your identity as the owner of the registered data. The interested party may exercise their rights by means of written communication addressed to CIVIR, C/ Cronos 10, Planta 4 – Oficina 2 (28037) Madrid or to the e-mail address DPD@civir.es proving their identity by means of a photocopy of their ID card, and with the following reference in their letter or e-mail: “LOPD-CIVIR”.

Rights of access (art. 15 RGPD)

  • Purpose of processing;
  • Category of personal data being processed;
  • Recipients or categories of recipients to whom the data will be communicated;

  • The existence of the right to request from the controller the rectification or erasure of personal data or the restriction of the processing of personal data concerning the data subject or to object to the processing of such data;

Right to rectification (art. 16 RGPD)

You have the right to obtain from CIVIR the rectification of inaccurate personal data concerning you. Taking into account the purposes of the processing, you have the right to have incomplete personal data completed, including by means of an additional statement.

Right to suppression, “right to be forgotten”(art. 17 RGPD)

The right to suppression gives you the right to obtain from CIVIR the deletion of personal data concerning you, when any of the following circumstances apply:

  • They are no longer necessary in relation to the purposes for which they were collected or processed;
  • When the data subject withdraws the consent on which the processing is based and this consent is not based on another legal basis.
  • When the data subject objects to the processing and no other legitimate grounds for the processing prevail.
  • When the personal data have been processed unlawfully.
  • Where the personal data must be erased in order to comply with a legal obligation under Union or Member State law applicable to the controller.
  • Where personal data have been obtained in connection with the provision of information society services directed at minors.

Right to object (art. 21 RGPD)

You have the right to object at any time, on grounds relating to your particular situation, to the processing of your personal data.

In such cases CIVIR will stop processing your personal data, unless it can demonstrate compelling legitimate grounds for the processing that override the interests, rights and freedoms of the data subject, or for the formulation, exercise or defense of claims.

 

Right to data portability (art. 21 RGPD)

This right can only be exercised:

  • When the processing is carried out by automated means;
  • When the processing is based on consent or a contract;
  • When the data subject requests it in respect of data that he/she has provided to the data controller and that concern him/her, including data arising from the data subject’s own activity.

On the other hand, it is not applicable:

  • To the data of third parties that a data subject has provided to a data controller.
  • In the event that the data subject has requested the portability of data relating to him/her but provided to the controller by a third party.

Right to limitation of processing (art. 18 RGPD)

The limitation of processing means that, at the request of the data subject, the processing operations that would be applicable in each case will not be applied to his or her personal data.

Limitation of processing may be requested when:

  • The data subject has exercised the rights of rectification or opposition and the controller is in the process of determining whether it is appropriate to comply with the request.
  • The processing is unlawful, which would result in the erasure of the data, but the data subject objects.
  • The data are no longer necessary for processing, which would also result in their erasure, but the data subject requests the restriction because he/she needs them for the formulation, exercise or defense of claims.

Right to not be subject to individualized decisions (art. 22 RGPD)

You have the right not to be subject to a decision based solely on automated processing, including profiling, that produces legal effects on him or her or similarly significantly affects him or her.

The foregoing is excluded:

  • Where it is authorized by Union or Member State law.
  • When it is necessary for the conclusion or performance of a contract between the data subject and a controller.
  • When it is based on the explicit consent of the data subject.

Our website uses the “G+” button of the social network Google Plus, operated by Google Inc, 1600 Amphitheatre Parkway, Mountain View, CA 94043, United States (“Google”).

The content of the “G+” button is transmitted directly by Google to your browser, which integrates it into the website. Therefore, we cannot influence the scope of the data that Google obtains with this button. According to Google, no personal data is collected if you do not click on the button. CIVIR reserves the right to modify its Privacy Policy, according to its own criteria, or motivated by a doctrinal, legislative or jurisprudential change of the Spanish Data Protection Agency. In such cases, CIVIR will announce on this page the changes introduced reasonably in advance of their implementation.

The use of the registration forms after the effectiveness of the changes introduced, will imply the acceptance of these changes.
